TERMS OF SERVICE — iTHINK EDU

The iTHINK EDU Terms of Service (hereinafter referred to as "Terms") govern the conditions, rights and obligations of Users and the iTHINK Education Organization (hereinafter referred to as "iTHINK EDU") when using digital education products and services on platforms provided by iTHINK EDU, including the website https://ithink.edu.vn and the mobile applications iTHINK Student, iTHINK Teacher.

The Privacy Policy is an integral part of these Terms.

Users must read carefully, understand and agree to all the contents of these Terms before using iTHINK EDU's products and services.

1.1. iTHINK EDU: Is the trade name of the iTHINK Education Organization (Representative: Mr. Tran Trung Kien) — the unit that develops and operates digital education platforms providing learning services, class management, exam creation, assignment distribution and other online education services.

1.2. iTHINK EDU Platform: Includes the entire website, mobile applications, software tools, APIs or other integrated channels built by iTHINK EDU to provide services to Users.

1.3. iTHINK EDU Account: Is the account registered and used by the User to access the iTHINK EDU Platform and use the services.

1.4. User: Is an individual or organization that registers an account and/or uses services on the iTHINK EDU Platform, including but not limited to: students, parents, teachers, schools, or partners.

1.5. Digital Education Services: Includes features such as exam creation, assignment distribution, class management, assessment, interactive learning, online courses, learning result reports and other support services provided by iTHINK EDU or its partners.

1.6. Education Partners: Are individuals and organizations permitted by iTHINK EDU to upload or provide content, courses, and educational programs on the iTHINK EDU platform.

2.1. Using the iTHINK EDU Platform means the User explicitly and comprehensively agrees to these Terms.

2.2. iTHINK EDU has the right to modify and supplement the terms at appropriate times without prior notice. The latest version will be posted on the website/application.

2.3. In case of disagreement with the modified terms, Users have the right to stop using the service.

• Teachers have the right to create an account on the iTHINK EDU platform through the system's official website. After registration, teachers can access and use teaching functions on the system according to the selected service package (free or paid).
• Teachers have the right to manage their personal accounts, including updating personal information, changing passwords, updating profile photos, email addresses and other security settings.
• Teachers have the right to request account deletion if they no longer need the service. Account deletion will comply with the information verification process and data protection policy of iTHINK EDU.
• Teachers have the right to create classes, add students to classes, create and assign homework and exams, as well as monitor student learning results and progress in the class.
• Teachers can use teaching tools, sample material repositories, exams, and other support resources according to iTHINK EDU's policies at each period.
• Teachers have the right to create their own learning content and have full rights to edit and delete this content within the classes they manage.
• Teachers can receive technical support from iTHINK EDU, submit feedback on technical errors or contribute ideas for platform improvement.

• Students can create an account on the iTHINK EDU platform through the web or mobile application, directly or through an invitation from their homeroom teacher/subject teacher.
• Students have the right to manage their personal information, including name, avatar, password, enrolled class information and account display settings.
• Students have the right to request account deletion or disassociation from a class, with approval from the managing teacher or system administrator (in cases where student accounts are under school-deployed categories).
• Students can access joined classes, complete assignments, take tests, view learning results, receive feedback and guidance from teachers.
• Students have the right to use free learning resources shared on the platform and store personal learning results.

• Use the iTHINK EDU platform according to the functions provided corresponding to the registered account type.
• Be ensured of safety and security for personal and learning data on the system.
• Request technical support, file complaints or report issues arising during use.
• Exercise other legal rights as provided by current law.

• Users (including teachers and students) are responsible for registering accounts with truthful, accurate information and updating information when changes occur.
• Users commit to being responsible for actions arising from their accounts. iTHINK EDU will rely on registration information and system logs to identify account owners in case of disputes. Accounts without complete information will not be supported in complaint cases.
• Users are responsible for securing their personal accounts and not sharing accounts or passwords with others. If information is leaked or account control is lost, Users bear responsibility for arising risks.
• Users commit to not illegally editing or interfering with the iTHINK EDU system, not spreading malware, offensive content, violations of educational ethics, copyright infringement, or other illegal activities.
• Users agree to immediately notify iTHINK EDU upon discovering unauthorized account use, serious system errors or abnormal behavior on the platform.
• During use, Users need to comply with class regulations (if any), behave appropriately in the learning environment and respect the community of teachers and students on the platform.
• Users may be subject to disciplinary action (warning, temporary suspension or permanent account lockout) depending on the severity of violation of regulations, usage agreements, or requirements from legal authorities.

• iTHINK EDU has the right to temporarily suspend or permanently lock accounts if Users violate the Usage Policy, spread illegal content, or affect the system and user community.
• iTHINK EDU has the right to collect and use User information for account management purposes, technical support, service notifications, promotion of new features or promotional programs (if Users agree).
• iTHINK EDU commits to not sharing User information with third parties unless with User consent or as required by competent legal authorities.
• iTHINK EDU has the right to change policies and service terms to comply with legal regulations and product development needs. These changes will be publicly announced on the system.
• iTHINK EDU has the right to use anonymized statistical data for analysis, research, and product improvement.
• iTHINK EDU has the right to refuse or stop providing services to any account that uses automated tools, cheating, hacking or violates professional ethics in the learning environment.

• iTHINK EDU is responsible for maintaining stable system operations, ensuring continuous access for Users, except in cases of maintenance or unintended incidents.
• iTHINK EDU is responsible for receiving and handling complaints, providing technical support, and ensuring the legal rights of Users if disputes arise during use.
• iTHINK EDU is responsible for protecting Users' personal information and not selling or transferring information to unauthorized third parties.
• iTHINK EDU is responsible for providing a healthy learning platform free of harmful content, violations of educational ethics and the law.
• In cases where Users report errors or engage in serious violations, iTHINK EDU may collect system logs and process related data without prior notice.
• iTHINK EDU is responsible for cooperating with authorities when there are investigation requests related to illegal activities occurring on the platform.

5.1. Some services on the iTHINK EDU Platform are provided free of charge, while others may require payment.

5.2. Paid fees are non-refundable in all cases, except when due to errors from iTHINK EDU.

6.1. iTHINK EDU has the right to suspend or terminate service provision if serious violations are detected or there is a risk of harm to the system/content/third parties.

6.2. Before terminating an account, iTHINK EDU will notify the User via email/application (unless due to serious legal violations).

7.1. The collection, use, storage and sharing of Users' personal data is carried out in accordance with iTHINK EDU's Privacy Policy publicly disclosed at the website https://ithink.edu.vn and on the application.

7.2. iTHINK EDU commits to protecting Users' personal data and private information in accordance with current legal regulations on data protection and information security.

7.3. Users are responsible for securing their login information and account-related information. iTHINK EDU is not responsible for any loss or damage caused by the disclosure of Users' security information.

8.1. iTHINK EDU provides the platform and learning/teaching support services with the highest effort to ensure accuracy, continuity and safety. However, iTHINK EDU does not guarantee that the service will be uninterrupted, error-free or free of cybersecurity risks.

8.2. iTHINK EDU is not responsible for any direct, indirect, incidental, special or consequential damages arising from Users' use or inability to use the platform or content on the platform.

8.3. Users are responsible for all content they create, post or share through the platform, including but not limited to lessons, exams, learning materials and interactions with other users.

9.1. iTHINK EDU has the right to suspend or terminate Users' access rights or accounts if signs of violation of these Terms are detected or as required by authorities.

9.2. Users can request account deletion at any time by submitting a request to iTHINK EDU. iTHINK EDU will process the request within a reasonable timeframe in compliance with legal regulations.

9.3. In cases where an account is suspended or terminated, all data related to the User will be processed in accordance with the provisions of the Privacy Policy.

10.1. These Terms are governed by the laws of the Socialist Republic of Vietnam.

10.2. Any disputes arising between Users and iTHINK EDU will be prioritized for resolution through negotiation. If resolution by negotiation is not possible, the dispute will be submitted to the competent People's Court in Hanoi for resolution in accordance with legal regulations.
